Terms of Service

These Terms govern your use of the authenticated product Service at app.bosnet.io. The marketing website at eikon.digital is governed by its own separate Terms of Service.
These Terms of Service (“Terms”) form a binding agreement between you (or the entity you represent) and Eikon Digital Solutions (“Eikon Digital,” “we,” “us”) governing your access to and use of the application located at app.bosnet.io and any associated APIs, agents, integrations, and outputs (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
BOSNet is a business operating system built on a patent-pending governance kernel. The primary interface is a natural-language user interface (NLUI) supported by artifact surfaces that present evidence, state, decisions, confirmations, anomalies, and requests for clarity. The Service may invoke tools, agents, large language models, and third-party integrations on your behalf, subject to the authorizations and governance controls active in your workspace.
2. Alpha Service — No SLA, No Warranty
The Service is currently in Alpha. It is provided for early evaluation and collaborative product development. We may, at any time and without notice:
- Modify, suspend, or discontinue all or part of the Service.
- Reset, migrate, or alter the structure of workspace data as the kernel evolves.
- Add, remove, or change tools, agents, integrations, or model providers.
- Impose usage limits, throttles, or rate restrictions.
There is no service-level agreement (SLA) and no uptime guarantee for the Alpha. Do not rely on the Service as the sole system of record for regulated, contractual, financial, or safety-critical operations during the Alpha period. Maintain your own backups and external records.
3. Eligibility & Accounts
To use the Service, you must be at least 18 years old and authorized to bind the organization on whose behalf you are accessing the Service. The Service is intended for legitimate business use only.
You are responsible for safeguarding your credentials, for all activity that occurs under your account, and for ensuring that anyone you invite into your workspace is authorized to access the data you share with them. Notify us promptly of any unauthorized access or suspected compromise at security@bosnet.io.
4. Acceptable Use
You agree not to:
- Use the Service in violation of any applicable law, regulation, or third-party right.
- Submit prompts, inputs, or content that would cause the Service to generate output that is unlawful, defamatory, infringing, deceptive, harassing, or that violates the rights of any person.
- Attempt to bypass, disable, circumvent, or interfere with the governance kernel, the audit trail, safety controls, rate limits, or authorization checks.
- Reverse engineer, decompile, or attempt to extract the source code, model weights, prompts, or proprietary methods of the Service, except to the extent applicable law expressly permits.
- Use the Service to develop a competing product or to benchmark for the purpose of publishing comparative claims, without our prior written consent.
- Use the Service to send unsolicited communications (spam), to scrape third-party services in violation of their terms, or to perform credential stuffing, fraud, or abuse.
- Upload material containing viruses, malware, or other harmful code.
- Use the Service to make decisions about a natural person that produce legal or similarly significant effects without appropriate human review and a lawful basis.
- Submit information about identifiable third parties without the legal right to do so.
We may suspend or terminate accounts that violate this section. Governance, safety, and abuse signals captured by the kernel may be used to enforce these terms.
5. Your Content
You retain all rights in the data, documents, prompts, and other content you submit to the Service (“Customer Content”). You grant Eikon Digital a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use Customer Content solely as necessary to:
- Provide, secure, operate, and support the Service.
- Execute the workflows, tool calls, and integrations you authorize.
- Generate and preserve the governance audit trail.
- Maintain backups and disaster recovery.
- Detect, prevent, and respond to abuse, fraud, and security incidents.
- Comply with applicable law and respond to lawful legal process.
We do not use Customer Content to train third-party foundation models, and we do not sell or share Customer Content with advertising networks. Aggregated, de-identified, or anonymized data derived from Service operation may be used to improve the Service.
6. AI-Generated Output
The Service uses large language models and other AI components to assist you. AI-generated output may be incorrect, incomplete, biased, or out of date and is not a substitute for professional advice (legal, financial, medical, tax, accounting, regulatory, or otherwise). You are responsible for reviewing, validating, and accepting any AI-generated output before relying on it, publishing it, transmitting it to a third party, or using it to make a decision that affects a person or a business outcome.
As between you and us, you are responsible for the output you choose to accept, including for any rights, licenses, or third-party claims associated with that output. The governance kernel records what the Service generated and what you accepted; that record is the audit trail.
7. Intellectual Property
The Service, including the BOSNet name and mark, the patent-pending governance kernel, the dimensional model, the NLUI surface, the artifact and compiler architecture, all software, designs, documentation, and any improvements or derivatives, is and remains the property of Eikon Digital Solutions or its licensors. Nothing in these Terms grants you any right or license to that intellectual property other than the limited right to use the Service in accordance with these Terms.
Feedback you provide about the Service may be used by us without restriction and without compensation.
8. Confidentiality
Information either party discloses to the other in connection with the Service that is identified as confidential or that a reasonable person would understand to be confidential (including the unreleased aspects of the Service itself, and Customer Content) is the disclosing party’s confidential information. The receiving party will use it only to perform under these Terms and will protect it with the same care it uses for its own confidential information of similar importance (and in no event less than reasonable care).
9. Fees
The Alpha Service may be offered free of charge, at a published Alpha subscription fee, or under a custom written arrangement. The applicable fee structure, if any, will be disclosed at the time you activate or upgrade your workspace. Fees are non-refundable except where required by law or as expressly stated in a written order between you and us.
10. Suspension & Termination
You may stop using the Service at any time and may close your workspace from within the Service or by contacting us. We may suspend or terminate your access, with or without notice, if we reasonably believe:
- You have materially breached these Terms.
- Continued access poses a security, legal, or operational risk.
- We are required to do so by law.
- We are discontinuing the Alpha or the Service.
On termination, the access license granted to you ends. Customer Content retention and deletion are governed by our Privacy Policy § 6. Sections of these Terms that by their nature should survive termination (including Sections 5, 6, 7, 8, 11, 12, 13, and 14) will survive.
11. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Eikon Digital Solutions disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising out of course of dealing or trade usage. We do not warrant that the Service will be uninterrupted, error-free, secure, free of harmful components, or that any output will be accurate, reliable, or fit for your purpose.
12. Limitation of Liability
To the maximum extent permitted by law, in no event will Eikon Digital Solutions, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or related to these Terms or the Service, even if advised of the possibility of such damages. Our aggregate liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred United States dollars ($100). These limits form an essential basis of the bargain and apply to all theories of liability.
13. Indemnification
You will defend, indemnify, and hold harmless Eikon Digital Solutions and its affiliates, officers, employees, and agents from and against any third-party claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or relating to (a) your or your users’ use of or misuse of the Service, (b) your Customer Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right. We will provide prompt notice of any indemnified claim and reasonable cooperation in the defense.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws principles. The exclusive forum for any dispute arising out of or relating to these Terms or the Service is the state and federal courts located in Jackson County, Missouri, and each party consents to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15. Changes to These Terms
We may update these Terms from time to time. We will reflect material updates by changing the effective date above and, where appropriate, by notifying you within the Service or by email. Your continued use of the Service after an update constitutes acceptance of the updated Terms.
16. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede prior or contemporaneous communications on the same subject.
- Severability. If any provision is held unenforceable, the remainder will remain in effect and the unenforceable provision will be reformed to the minimum extent necessary.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
- Notices. Notices to you may be delivered through the Service or to the email address on your account. Notices to us must be sent to the contact address below.
- Force majeure. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control.
- No third-party beneficiaries. These Terms do not create third-party beneficiary rights.
